How We Use Your Personal Data

Sharing Your Personal Data
We may share your Personal Data by disclosing it to a third party for a business purpose, including third party suppliers and service providers (including vendors providing hosting, database management and development services related to the operation of our Websites, outsourcing providers of our back-office and internal functions, technology service providers, and/or email marketing services related to communications we may send to you). We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the Personal Data confidential, and prohibit using the disclosed Personal Data for any purpose except performing the contract.

Retaining Your Personal Data

We collect your Personal Data when you apply to work for us, upon hiring, and throughout your employment with us. When you enter into discussions with us regarding access to land you own or lease, we collect a significant amount of Personal Data from you. We may collect: (i) contact information, such as your name, address, email address, and phone number; (ii) payment information, such as the name of your bank and your bank account number. The Personal Data collected by us, or on our behalf, during the admissions process is collected for the primary purposes of negotiation right of way agreements and making payments to you. We process your Personal Data for the purposes described above on the basis of our legitimate interests (for example, to process the right of way agreements); to process transactions requested by you and meet our contractual obligations (for example, to process our payments to you); as necessary for compliance with our legal obligations (for example, regulatory reporting); or on the basis of your consent. Where we have determined that the legal basis for processing your Personal Data is that it is necessary to serve our legitimate interests, we have concluded that our interests do not inappropriately impact your fundamental rights and freedoms with respect to your Personal Data.
Special Provisions Applicable To Certain Individuals Outside Of The United States
In addition to the provisions set forth elsewhere in this privacy policy, the following provisions apply to certain individuals located outside of the United States.
Your Personal Data will be stored on the servers of cloud-based services we engage. If you are outside of the United States, you should understand that we may transfer your Personal Data to the United States. Because the United States has not sought or received an adequacy decision under GDPR, we rely on appropriate safeguards and on derogations for specific situations that are recognized under GDPR when transferring your Personal Data to the United States.

Such websites are independently operated and are not under our control, and the privacy practices of such third party websites are not governed by this privacy policy. We are not responsible for the content or privacy practices of such third party websites or any products or services offered through them or the confidentiality, use, processing and security of any Personal Data that you provide to such websites.
Children’s Access
Our Websites are not directed to children under 13 and we do not knowingly collect Personal Data from children under the age of 13. If we learn that we have collected Personal Data of a child under 13, we will take steps to delete that Personal Data as soon as possible.

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your Personal Data.
You may only submit a request to know twice within a 12-month period. Your request to know or delete must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Data or an authorized representative, which may include:
- email address and phone number.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with Personal Data if we cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.
We will only use Personal Data provided in the request to verify the requestor’s identity or authority to make it.
Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within that timeframe, please contact 1-800-863-6684.
We endeavor to substantively respond to a verifiable request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Data that is readily usable and should allow you to transmit the information from one entity to another entity without hindrance, specifically Excel or CSV.
We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your legal rights. Unless permitted by applicable law, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
